Do's & Don'ts

With an increasing number of couples deciding to live together and not marry, complications can arise upon any ultimate separation.

Unknown by many ‘Common Law marriages’ do not in fact exist, this is simply a myth.

The Courts have far wider and greater powers when dealing with the financial affairs of a couple who are either married or in a civil partnership, than they do for unmarried couples.

We often find it would be far more advantageous for couples who intend to live together, to consider a Living Together Agreement.  Such an agreement records a couple intentions and financial contributions and obligations to one another.

Although it may not be a romantic ideal, it can provide a strong basis to embark upon co-habitation, and in the unfortunate event of separation, matters will be somewhat simplified.

Living Together Agreements are not automatically enforceable, although if entered into correctly, with both parties having taken legal advice, the Courts are likely to attach considerable weight to the existence of such an agreement.
